Shin Wai Babu Kyau Kwana Da Yara Aɗaki Ɗaya, Kuma Bai Halatta Sukwana Aɗaki Su Kaɗai Ba ko da An Musu Addu'a.

الحمد لله أدبنا بالأخلاق الفاضلة.

Kwana ɗaki ɗaya dayara ko yaro wanda baya iya ban-bance komai kamar yaron da'ake shayar dashi ba a samu wani umarni na shari'a akai ba, babu wani hadisin Annabi ﷺ akan hakan, sai wani asar kwaya ɗaya wanda ba hadisi bane, maganace aka ruwaito daka wasu daka cikin magabata daka cikin malikiyyah, wacce suka dogara da ita daka Umar bin khaddab yardar Allah takara tabbata a gare shi, ya kasance idan zai yi jima'i da iyalinsa yana fitar da jariri daka ɗakin, dankaiwa makura wajan kunya da suturce kai, amma ba bayanine na hukuncin shari'aba, ko Umarnin da'aka dorawa mutane, babu laifi koyi dashi gawanda yakesan hakan, kuma gidansa akwai yalwa, baya kuma tsoran wata cutarwa gayaron idan yabarshi aɗaki shikaɗai ba tare dayana ganinsa ba, amma lazimtawa mutane ko da yaushe, bai halatta.

Yazo a cikin mausu'ah fiƙhiyyah (3/178)

" Wajibi ne mutum ya suturta daka yaro mai iya gane abu adakinsa shida matarsa, ko baiwarsa, ko waninsu kada sugansu, kada suji alamun abun da suke aikatawa, haka mafiya yawan malamai sukace,

An tambayi hasanul basari rahimahullah game da wanda yake da mata biyu a gida ɗaya, ya ce: Magabata yana nufin sahabbai sun haramta yasadu da ɗaya daka cikin matan nasa dayar tana gani kotanaji.

Malikiyya sukace: Ya suturta daka samuwar mai bacci aɗaki, bai halatta mutum yasadu da matarsa ko baiwarsa adakin da akwai wani a cikin dakin, idansa biyu ko yana bacci, domin mai bacci zai iya farkawa yagansu awannan halin.

Mutum yasuturta daka samuwar yaro karami aɗaki, ko da baya iya gane abubuwa koyi da umar ɗan khaddab, Umar ya kasance yana fitarda da yaro karami daka ɗaki idan yana san jima'i da iyalinsa.

Jamhurdin malamai suntafi akan cewa basai mutum ya suturta daka yaro karami wanda baisan komai ba, harda wasu daka cikin malikiyyar, saboda abun dake cikin hakan na wahala da takura, " madkal" Na ibnul haaj Almaliki (2/184).

Ibnu Usaimin a cikin sharhin mumti'i(5/380) bugun misra ya ce:

" Abun da yake sahihi awananna mas'alar shi ne: haramun ne saduwa wani yana gani, saidai idan mai kallan yarone wanda baisan me akeba, kuma ba zai iya suranta maiya gani ba, wannan babu laifi, amma idan zai iya sifanta abun da yagani, bai kamata a yi jima'i yana dakinba ko da yarone, domin yaro yana iya fadar abun da yagani ba tare daya nufaci fadar ba.

Amma wanda ake shayarwa wanda yake da wasu watanni, wannan babu laifi, domin shi baisan abun da akeba, saidai wanda yake da shekara uku, ko huɗu, bai kamata mutum yasadu da iyalinsa yana dakinba, domin yaro dasafe yana iya ba da labari.

Saboda haka aka haramta saduwa da iyali yaro na gani, ko da baya iya ban-bance abubuwa, idan yana iya sifanta abun da yagani, kuma yana iya fahimta.

Saboda haka kwanciya dayara aɗaki halal ne, baya zama haramun ko abun zargi, sai in mace da mijinta za su biya bukatarsu, anan haramci ke shiga, shima sai idan yaron yakai yana iya gane me suke aikatawa kuma zai iya bayyana yanda yaga sunayi, anan kwana ɗaki ɗaya dayara ke zama abun zargi.

Amma dan kwanciya dasu haka siddan kamar mahaifinsu baya nan ko bamai zaman gida bane, babu laifi uwa takwana da 'ya'yanta mata aɗaki ɗaya ko da suma sun balaga.

Cewa bakyau abar yara su kwana aɗaki su kaɗai ko da an musu addu'a wannan kuskurene, babu wata aya ko hadisi ko maganar wani magabaci akai.
