Neman Saki Don Karayar Tattali Arziƙi

     𝐓𝐀𝐌𝐁𝐀𝐘𝐀

    As-Salaam Alaikum. Menene hukuncin addini a kan macen da ta nemi mijinta ya sake ta bayan sun yi shekaru 11 da aure, a sakamakon ƙuncin tattalin arziƙi da ya shiga, duk kuwa da kasantuwar ita ɗin tana da aikin yi kuma tana takura masa sosai, har abin ya kusa taɓa hankalinsa?

    Wa Alaikumus Salaam Wa Rahmatul Laah.

    [1] A bayan taimakon Allaah Ubangijin Halittu babu abin da ke riƙe gidan aure a mahangar musulunci kamar: Haƙuri da tausayi a tsakanin ma’aurata. Allaah Ta’aala ya ce

    وَمِنْ آيَاتِهِ أَنْ خَلَقَ لَكُمْ مِنْ أَنْفُسِكُمْ أَزْوَاجًا لِتَسْكُنُوا إِلَيْهَا وَجَعَلَ بَيْنَكُمْ مَوَدَّةً وَرَحْمَةً إِنَّ فِي ذَلِكَ لَآيَاتٍ لِقَوْمٍ يَتَفَكَّرُون

    Kuma daga cikin ayoyin Allaah akwai ya halitta muku matan aure daga ciki nau’inku domin ku natsu da su, kuma ya sanya ƙauna da tausayi a tsakaninku. Haƙiƙa a cikin hakan akwai ayoyi ga mutane masu tunani. (Surah Ar-Ruum: 21).

    Bai kamata sauyin yanayin rayuwa kamar na lafiyar jiki ko tattalin arziƙi ya zama dalilin rabuwar aure ba. Domin samu da rashi abubuwa ne da suke a hannun Allaah Ubangijin Halittu, yana shimfiɗa arziƙi ga wanda ya so daga cikin bayinsa. Haka kuma yana ƙuntatawa ga wanda ya so. A kan maganar ciyarwa a bayan rabuwar ma’aurata ne Allaah ya ce

    لَا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا مَا آتَاهَا، سَيَجْعَلُ اللَّهُ بَعْدَ عُسْرٍ يُسْرًا

    Allaah ba ya ɗora wa kowane rai sai dai abin da ya ba shi kawai, kuma Allaah zai sanya sauƙi a bayan tsanani. (Surah At-Talaaq: 7).

    A ƙarƙashin wannan, idan daga baya Allaah ya sauya yanayin waɗannan ma’auratan ya mayar da mijin mawadaci ita kuma ya raba ta da aikin ya talauta ta, ya ya kenan?

    [2] Malamai dai sun saɓa wa juna a kan raba auren matar da mijinta ya talauce, kamar haka

    i. Waɗansu sun zaɓi cewa matuƙar matar ta zaɓi a raba auren to lallai a raba, kuma dole a tilasta wa mijin ya sake ta matuƙar dai ba ya iya ciyar da ita. Sun kuwa kafa dalili da maganar Allaah Ta’aala cewa

    وَلَا تُمْسِكُوهُنَّ ضِرَارًا لِتَعْتَدُوا

    Kuma kar ku cigaba da zama da su a kan cutarwa, domin ku ƙetare haddi. (Surah Al-Baqarah: 231).

    Suka ce: Lallai akwai cutarwa ba kaɗan ba a cikin zamanta tare da shi alhali ba shi da wadatar ciyar da ita.

    ii. Waɗansu kuma suka ce haƙuri gare ta ya zama dole har zuwa lokacin da Allaah zai yalwata masa. Suka ce: Annabi (Sallal Laahu Alaihi Wa Alihi Wa Sallam) bai taɓa raba auren wata mace saboda talauci ko ƙuncin tattalin arziƙin mijinta ba. Kuma a lokacin da matan auren Manzon Allaah (Sallal Laahu Alaihi Wa Alihi Wa Sallam) suka nemi ya ƙara musu kuɗin cefane sai Abubakar da Umar kowannensu ya tashi zuwa wurin ’yarsa (A’ishah da Hafsah (Radiyal Laahu Anhumaa)) yana zargin ta a kan hakan. (Sahih Muslim: 1478).

    Suka ce: Idan da wannan abin da matan suka yi daidai ne, kuma in da haƙƙinsu ne neman ƙarin kuɗin cefane a lokacin da miji ba shi da hali, to da kuwa Annabi (Sallal Laahu Alaihi Wa Alihi Wa Sallam) bai amince har ya ƙyale Abubakar da Umar (Radiyal Laahu Anhumaa) da abin da suka aikata ba.

    iii. Wani malamin kuwa shi cewa ya yi: Idan dai ita macen ta zama mai wadata, to haƙƙin ciyarwar ta komo a kanta, har zuwa lokacin da zai samu yalwar arziƙin ɗaukar hakan. Daga nan sai nauyin ya komo kansa.

    iv. Wani malamin kuma ga yadda ya fayyace al’amarin:

    (i) Idan tun farko mijin ya yaudare ta ne cewa shi mawadaci ne kuma sai ta amince ta aure shi a kan hakan. Daga baya kuma sai ya bayyana a matsayinsa na talaka fitik, to a nan tana da ikon neman ya sake ta.

    (ii) Amma idan an ƙulla auren alhali tana sane da cewa shi talaka ne, ko kuma mawadaci ne sai kuma ya talauce daga baya, to a nan ba ta da haƙƙin neman ya sake ta a bisa ƙa’idojin shari’a. Domin tun a zamanin musulmin farko an sha samun yanayin da tattalin arziƙin mazajen aure ke karyewa ko ƙuntacewa, amma matan aurensu ba su riƙa kai kuka wurin mahukunta don neman a raba aurensu ba. Haƙuri kawai suka riƙa yi. (Zaadul Ma’aad: 5/521).

    [3] A ƙarƙashin waɗannan bayanan, abin da na ga ya kamata shi ne: Wannan matar ba ta da haƙƙin neman a warware aurenta ko ta nemi saki daga wurin mijin, musamman dayake tana da wadata. Kamata ya yi ta cigaba da haƙurin zama da mijin, kuma ta cigaba da ɗaukan nauyin gidan da gwargwadon iko a ƙarƙashin maganar malamai ta-biyu, har zuwa lokacin da zai samu wadatan sake ɗaukar ragamar nauyin gidan. Daga nan sai ya biya bashin abin da ta riƙa ciyar da kanta da sauran iyalinsa. Idan kuma ta yafe masa ko ta ɗauki maganar malami na-uku shikenan.
